coastline. we could see more. we'll talk about that coming up. >> and we just had some overnight roadwork outside right now so if you are going across the dumbarton bridge or bay bridge we'll break it down for you coming up. new hope this morning for a bay area mother dealing with the loss of her daughter for decades. police are testing a bone fragment taken from a san joaquin county well. cbs 5 reporter anne makovec is in hayward now with michaela garecht's mother's reaction to new developments. >> reporter: the police department here eagerly awaiting the results of the test. they first tested the bones here with inconclusive results and the bone is being sent to a lab in virginia. results who that bone belonged to could take weeks. investigators want to know if it belongs to michaela garecht. she was abducted in hayward in 1988. she was nine years old. that bone was initially given

to the family of another victim joanne hobson's remains found in a linden well in february when hobson's family received the remains. they ordered the tests. they were suspicious when they saw the site dug up with a backhoe. 28 of the bone fragments given to that family belonged to at least three other people including a child between the ages 56 and 14. >> that's truly shameful. i have to thank joanne hobson's family because they received their daughter's remains and rather than just accepting it this went to the trouble of having it tested. >> reporter: i sketch of michaela's alleged abductor looks similar to "speed freak"

serial killer loren herzog. a cellmate said he had family right near hayward. a lot of people in the community wondering if this could finally be the closure that they have been waiting for, for decades. right now live in hayward, anne makovec, cbs 5. a break in the investigation into the murder of a retired teacher in her hercules home. two people are now being held for a crime spree that began with a jail break in san bernardino county in august. it ended with a police chase near seattle yesterday. police there spotted the stolen car, the murder victim susie ko. they say the driver rammed patrol cars with the subaru. darnell washington and his wife were arrested. >> we know they were in the stolen vehicle and there are people we want to talk to. if they are not the suspects, hopefully they can give us information that will lead us back to the suspects. >> hercules police have gone up

to washington to question the couple about ko's killing and they are also suspects in the attempted murder of an l.a. county sheriff's deputy just last month. san jose serial arsonist strikes once again. a garbage bin was set on fire around 8:00 last night on the 1100 block of dellna manor lane the same area where there flyers given out yesterday. good samaritans put out the fire. this is the ninth fire in the area. vice president joe biden and republican vice- presidential nominee paul ryan will lock horns this evening in their only scheduled debate. randall pinkston has a preview from danville, kentucky. >> reporter: congressman paul ryan arrived in kentucky ahead of his first nationally televised debate. the number 2 man on the gop ticket told reporters earlier in florida, voters will see a clearchoice when he faces off against vice president joe biden. >> joe biden has been on this stage before. he has been on these big stages.

it's my first time. but what he can't run from is president obama's indefensible ortho. they are just offering more of the same. >> reporter: ryan will face an opponent who occasionally causes controversy with freewheeling statements. republicans also know vice president joe biden is a seasoned debater. >> 30, 40, 50, 60, million people, nothing like standing up before them. >> reporter: usually vice- presidential debates don't affect elections but many believe democrats are desperate for vice president joe biden to make a strong showing after president obama's poor showing in the first presidential debate. >> after this horrific debate that president obama had last week, it could stop the bleeding. >> reporter: new polls from three battleground states show romney has a one-point edge in colorado. in wisconsin the race is tight. the 6 point lead is down as to 3 points for the president and

virginia a five-point lead. they debate a second time next week in new york. randall pinkston, cbs news, danville, kentucky. >> the vice president debate is at 6:00 on cbs 5 tonight. a new cbs 5 surveyusa poll shows mixed results for proposition 30. governor brown's plan to raise taxes to avoid further cuts to public safety and education. when asked about prop 30 with only a prescription, 38% said they would vote no. 33% said yes. 29% not certain. but when prop 30 was explained in detail, the results were different. take a look. the yes respondents outnumbered the nos 45 to 39%. prop 30 would temporarily raise the state sales tax by .25% and raise the income tax on those earning more than a quarter million dollars a year. what a day for bay area baseball fans. as and giants both digging deep last night.

row weather moving across the bay area. you know, i was asleep last night i woke up to thunder. >> it was something else, strong storms developing in the south bay. we talked about that yesterday but things unsettled and we had lightning strikes showing up around the bay area again this near watsonville pretty strong thunderstorms rolling through that area making for not only the league but we also had reports of some big hail moving through, as well. we still have a chance of a few thunderstorms but again i think the target will be a little bit further south once again. outside right now, hi-def doppler showing scattered light showers at this time again this rotating around. that area of low pressure that's been slowly work its way into southern california but as it wraps around some of that moisture moves back into the bay area but i think the focus again will shift further south throughout the day and looks like parts of the south bay could see some thunderstorms so watch out for that. temperatures mainly in the 50s outside. by the afternoon it's going to stay cool. 60s and low 70s. there's a warmup on the way.

we'll talk more about that in a moment. right now let's check out the roads with elizabeth. >> just your overnight roadwork so nothing major outside right now. here's a live look at the bay bridge toll plaza. there is roadwork on the upper deck. should be wrapping up here in the next 20 minutes or so but right by the cantilever section, again heading into san francisco, one lan blocked. eastbound 92 san mateo bridge towards hayward sounds like a couple of lanes blocked until 6:00 this morning. that's when caltrans says they will be out there. in the commute direction westbound 92 still looks good leaving the east bay. to our maps, here's a live look at 880 in oakland. maybe you can see some flashing lights there. there are some caltrans crews hard at work from fruitvale towards the downtown oakland exit. southbound 880 looks good past the coliseum. and all the way down towards hayward. hey, our dumbarton bridge roadwork just wrapped up on highway 84 both directions so now that's free and clear. mass transit, we always like to encourage folks to use it. everything so far off to a nice start, bart, ace, muni,

caltrain and ferries. that's your "timesaver traffic." back to you guys. >> thank you. 4:39. san francisco sheriff ross mirkarimi is back on the job but could be facing a new recall threat. one supervisor who voted to reinstate the embattled sheriff, jane kim, told the "chronicle" she would support a recall effort against mirkarimi. she say she voted out of concern it would set a precedent about what constitutes official misconduct. meantime san francisco's d.a. is asking mirkarimi to recuse himself from certain cases. >> we're questioning his ability to deal with domestic violence matters during the period of time where he is on probation for committing the same type of crime. >> seven members of the 11 board members voted to remove mirkarimi. but he needed nine votes. mirkarimi pleaded guilty in march to misdemeanor false imprisonment stemming from an argument before he took office that left his wife's arm

bruised. about 20 protestors are in hot water after clashing with police in san francisco. the protests began yesterday afternoon as a group called "homes not jails" marched down 18th street and broke in a vacant building on castro street. police eventually stormed the building and arrested the people inside. the protests he could insignedded with world homeless day -- coincided with world homeless day. a 12-year-old girl is caught in a shooting crossfire in oakland. she was hit in the leg last night. she was sitting in a car with her father on the 6200 block of harmon avenue when she was hit. the girl was treated at the hospital. she is expected to be okay. several houses by the way in that area were also hit by gunfire. the city of oakland suing the federal government over medical marijuana. the suit is aimed at stopping the feds from shutting down one of oakland's largest pot dispensaries. it claims federal officials promised not to raid dispensaries that follow state law and that shutting down the facility would send patients to the black market.

another suit in the news is a move to stop at least part of the central subway under construction here in san francisco. the suit says it's against the city charter to use union square for an entrance to that subway. today federal officials are expected to announce nearly a $1 billion federal for that subway project. time now 4:41. hope to heartbreak. a body is found during the search for a missing colorado girl. >> plus, are we throwing away expired medications too soon? the results of a new ucsf study. >> and the bizarre chase through the streets of oakland when we come back. ,,,,,,,,,,,,,,

weaved in and out of traffi, ed up on sidewalks, cameras catch a joyride through oakland on an atv. for several minutes this guy weaving in and out of traffic jumped up on sidewalks, ran through stop lights, stop signs and disappeared under a group of trees. now, we initially heard he was being chased but oakland police

and chp officers and the sheriff's department all say they don't know anything about him. time 4:44. when i went to bed last night, oakland as were down 2-0. >> i did the same thing. i tried to stay up. oh, gosh they are going to lose. i wake up this morning and how exciting was that. >> i couldn't believe it. as and giants what a day it's going to be for baseball here in the bay area. you know what? the weather, it got really interesting yesterday afternoon as well as we have some severe thunderstorms popping up in the south bay. right now, just some light showers showing up around the bay area again. look at it wrapping around moving away from the coastline as that low continues to work into southern california. now, things could change as we head throughout the day today. we may see some more rain picking up maybe some thunderstorms into the south bay once again so we need to watch that one closely. a lot of clouds out there now just some light sprinkles and showers being reported and that's about it but this low very slowly moving now and working to the south. you can see all that moisture just wrapping around in here. and that's what could spark

some of the showers. our computer models picking up on some of that. a lot of clouds and cool conditions for the better part of day and late in the day look at that wrap around moisture from morgan hill and san jose and gilroy, embedded thunderstorms this afternoon. then things settle down tonight and tomorrow. temperatures will be way down. 68 san jose. 61 pacifica. east bay numbers in the 60s maybe low 70s by the afternoon. even inside the bay temperatures cool today. 64 oakland. 64 san francisco. 60 stinson beach. next couple of days, the weather is going to take a turn for the better toward the weekend. 70s, 80s making a return and next week, we're talking about an offshore wind maybe getting near 90 degrees in some of the hottest spots by wednesday and thursday. how about that. >> heat wave again. thank you, lawrence. let's go outside. here's a live look at the golden gate bridge. you may find some slick spots. doesn't sound like the north bay though. everything is free and clear across the deck of the golden

gate bridge. and that drive time is definitely in the green. so i have not seen the lane change trucks move past yet but this is likely right around the time of the morning they reopen more southbound 101 lanes towards doyle drive in san francisco. elsewhere the nimitz, this is where you find some roadwork in lanes maybe some flashing lights caltrans crews still hard at work from fruitvale towards embarcadero. southbound 880 is fine past the oakland airport. if you have an early-morning flight or if you are continuing down towards hayward it looks great into milpitas. elsewhere dumbarton bridge roadwork i'm picking up a little bit of slowing on our sensors now so they may be picking up the last remaining cones. they were doing overnight roadwork on both directions of highway 84 so heads up there. mass transit continues to run on time. we are off to a great start for bart. ace train 1, muni, caltrain and ferries. traffic and weather together every 10 minutes. back to you guys. >> thank you. time now 4:46. another nobel prize was announced in sweden just a

short time ago. chinese writer mowian was named the winner of the nobel prize in literature. the swedish academy which selects the winners praised his work saying it merges folk tales, history and the contemporary. in the financial world treasury secretary timothy geithner announced the u.s. would support a bailout plan for spain by the international monetary fund. asian stocks were down this morning in response to the worsening economic struggles in spain. late yesterday, standard & poor's cut its rating on spain's debt by two notches to bbb minus. that leaves the country on the brink of junk status. 4:47 now. the u.s. anti-doping agency says lance armstrong was the master mind of a widespread doping conspiracy. his 11 former teammates back up the claim. the seven-time tour de france champ had dared the agency to prove he cheated and continues to say it is a witch hunt. now they say they have enough evidence to say armstrong was at the center of the most

sophisticated doping program professional cycling has ever seen. >> this is the first time we have seen something this well organized, this sophisticated, that was all designed essentially to cheat sport and win. >> the report claims armstrong also expected fellow riders to use banned substances. his lawyer calls the report a one-sided hatchet job. investigators in colorado have found a body but they are not saying if it's that of a 10- year-old girl that went missing. jessica ridgeway was last seen friday when she left for school. investigators found human remains yesterday. no other details have been released. ridgeway is believed to have been abducted. a construction worker survives the collapse of a parking garage in miami. the roof of the five-story structure fell at the miami- dade community college yesterday. the man was trapped under a huge slab of concrete for about 13 hours. he is now in critical condition.

one worker is still unaccounted for. eight others were injured. evidence in the colorado theater shooting will be made public today. that's expected to happen during a court hearing for the accused shooter james holmes. prosecutors will also add 14 more counts of attempted murder to the charges. that will bring the number of criminal counts against holmes to 166. 12 people were killed and 58 injured during the shooting back in july. here's some breaking news for you. gas prices are actually lower this morning here in the bay area. believe it or not. aaa reports the average for a gallon of regular in san francisco is about $4.73 down a tenth of a cent from yesterday. so for every 10 gallons pumped you will save a nickel but it is a start. oakland's average is down eight tents to just above $4.66 and in san jose it's at $4.657, down more than a penny from yesterday. but some new information out of richmond could keep prices volatile at least for several more months.

chevron says the crude unit damaged in the fire last august will remain offline for the year. chevron says it's trying to get permits necessary to fix the equipment there. and there's word this morning that a settlement could be close concerning billions of dollars worth of damage from the deepwater horizon oil rig explosion 2.5 years ago in the gulf. the "wall street journal" reports bp and the u.s. justice department have picked up talks now in the last couple of weeks. the explosion killed 11 workers and, of course, caused oil to hit the beaches in five gulf coast states. a big security breach could impact 200,000 students in florida. northwest florida state college announced a data breach of 76,000 current and former students. the breach also involves information on some of the college's top employees about 50 employees at the school reporting issues with identity theft including the college's president. foreclosure activity in the

united states fell to a five- year low last month. 580,000 filings were reported last month the lowest since 2007 down 7% from the previous month and 16% decline interest a year ago. realtytrac says california, michigan and georgia are the biggest drops in foreclosures. san jose-based ebay has a new look. the online retailer redesigned its website hoping to encourage visitors to browse and collect items to buy later. ebay also launched a new application called ebay now that lets shoppers order items from other retailers with same- day delivery. in your healthwatch this morning, if you toss out medication as soon as it expires, you might be jumping the gun. a researcher with uc-san francisco found that some drugs are still potent 40 years after their expiration date. two of the drugs tested were aspirin and amphetamine.
